Penkridge Markets are committed to protecting your personal information. This privacy notice explains how we collect and use the personal information about you.

Who we are

Penkridge Markets is a family run partnership. The registered office for which is Clovelly, Pinfold Lane, Penkridge, ST19 5AP. We operate the site known as ‘Penkridge Market’ and the website www.penkridgemarket.co.uk.

Information we collect about you

Your information is collected from:
  • a) Trader registration forms
  • b) Event booking forms – including Fine Food and Craft Market, Children’s Market, Victorian Christmas Market, Bank Holiday Market and Car Boot Sales
  • c) Poultry Auction registration forms and mailing list consent forms
  • d) Poultry Auction biosecurity declaration forms
  • e) Contact via phone
  • f) Email, post and mail correspondence
  • g) In-person contacts with our partners and employees
  • h) Information entered on our website
  • i) Penkridge Markets social media channels
  • j) Information we receive from external third parties, where relevant.

What information is collected?

We collect and hold details of your name, address, business name, contact telephone number(s), email address, business website.

Information about connected individuals

Our trader registration forms ask traders to provide emergency contact details of who we should contact if something should happen to you whilst on site. It is your responsibility to ensure that you have the consent of the people concerned to pass their information onto us and we ask you to ensure you pass the privacy information to them. For ease this document is available to view on our website www.penkridgemarket.co.uk.

We will use your information to:

  • a) administer your bookings for events
  • b) manage your trader and/or poultry auction account with us
  • c) to trace the movement of birds through the auction as required by the APHA.
  • d) maintain relevant contact, including, but not limited to sending traders regular newsletters, information about reward/loyalty schemes, site information, policies, rules etc
  • e) where you have consented to receive mailings from us we will also contact you with information relevant to the areas of interest you selected on the consent form. If you have consented to receive marketing you may opt out at a later date. You have the right at any time to stop us from contacting you for marketing purposes. If you wish to unsubscribe please click on the ‘unsubscribe’ button on the bottom of our emails or contact us using the contact details at the end of this document.

Legal basis of processing data

For Traders, the legal basis of processing data is ‘contract’ as defined by Article 6 of the General Data Protection Regulations where processing is necessary for the performance of a contract to which the data subject is party, in this case the contract for trading on the site.

For Poultry Vendors and Purchasers the legal basis for processing data is for the performance of our contract with you. Without collecting your personal data we would be unable to fulfil our legal obligations regarding traceability of birds bought and sold through the auction.

We process data included on the biosecurity declaration using ‘compliance with a legal obligation’ as defined by Article 6 of the General Data Protection Regulations as the lawful basis of processing.

We rely on ‘consent’ as the lawful basis of processing details on our mailing lists.

In other instances we may also rely on the ‘legitimate interest’ basis for lawful processing.

Who might we share your information with?

We will not share your information for marketing purposes with other companies.

We sometimes share your personal data with trusted third parties for example IT companies who support our website and other business systems, online booking form management companies who help us provide an online booking facility for our events and direct marketing companies who help us manage our electronic communications with you.

We may be required to share your information with third parties for legal reasons such as sharing information with law enforcement bodies about fraudulent or potentially fraudulent activity on our premises or computer systems, sharing information about Vendors and Purchasers at a Poultry auction following a request for information from DEFRA or the APHA for biosecurity reasons.

Where your personal data may be processed

Sometimes we will need to share your personal details with third parties outside the European Economic Area (EEA), such as the USA. We may transfer personal data that we collect from you to third party data processors in countries that are outside the EEA. If we do this, we have procedures in place to ensure your data receives the same protection as if it were being processed in the EEA for example we will only use companies who have certified compliance to the EU-US Privacy Shield framework. Examples of where we share your details outside the EEA are we use MailChimp for managing our mailing lists and direct marketing. MailChimp is a US company and their Privacy Shield Framework is GDPR compliant.

How long will we keep your information?

Your personal data will be retained for as long as necessary for the purposes of processing listed above. Your data will be deleted if you withdraw consent to processing or the data is no longer required or inaccurate. We are subject to legal requirements to retain certain data for specified minimum periods. These are minimum periods during which we have a legal obligation to retain your records. You have the right to request deletion of your personal data. We will comply with this request, subject to the restrictions of our legal obligations and legitimate interests.

Keeping information up to date

We have an obligation to ensure that your personal data is accurate and up to date. To assist use in achieving this we would like you to keep us updated if the personal data we hold on you is inaccurate and advise us if your personal details change in any way e.g. name change, change of address, change of contact number etc. If you would like us to update or correct any details we hold about you please contact us using the details at the end of this document.

Your rights to access information we hold on you

You have the right to request a copy of the information we hold about you. If you would like a copy of some or all of your personal information, please write to us using the contact details at the end of this document. We will require you to prove your identity by providing suitable approved ID. We will respond within one month of receipt of your written request and prove of your ID. We will not charge for handling any requested for information unless the request is manifestly unfounded or excessive.

Other rights

You have the right to have the data we hold about you transferred to another organisation for their use.

You have the right to object to certain types of data processing such as direct marketing.

You have the right to object to automated processing.

Complaints about Data Processing and Data Protection

If you are unhappy with our handling of your data please inform us in writing at the address below. We will acknowledge receipt of all complaints and will investigate the complaint and respond to you as soon as reasonably practicable.
